The availability of any advertised or provided service or documents depends on the databases that EquiResolve can access, in accordance with EquiResolve’s document retrieval standards.  EquiResolve is absolved of any responsibility for order processing failures resulting from circumstances or situations beyond its control. In cases where delays occur due to factors outside EquiResolve’s control, customers will be notified, but refunds will not be issued.  Delayed orders will be processed upon the restoration of any delayed system according to the order that an order was received and a customer's chosen delivery preference.

EquiResolve bears no responsibility if a customer/user fails to respond and/or communicate via email or any other means of communication. EquiResolve's liability is limited to the work EquiResolve performed, and our fee or payment from a user/customer is independent of their responsiveness to EquiResolve’s efforts. EquiResolve retains payment for the work performed, regardless of whether a user and/or customer responds to our communications or fulfills the processing requirements. No refunds are granted.  User acknowledges and agrees that EquiResolve is not obligated to provide any refunds to customers under any circumstances.

Fees listed are per case and include EquiResolve's communication of any kind with only one person/party.  If other persons/parties require communication of any kind, additional fees per party/person apply which will be noted at the time payment is received from a customer.  The fees charged for "I Want To Negotiate A Settlement", "I Want Payment Arrangements", "I Paid This", "I Want to Pay This", or "I Want to Fight This" retains our services to attempt to perform these services for only a 3-month period of time from the date that payment is submitted for the service(s) selected.  EquiResolve's involvement in performing any service that EquiResolve offers does not guarantee in any manner that parties will reach an agreement of any kind or that the service selected will be a success for the customer. EquiResolve's service fee is for our office to perform the selected service using our staff to perform a selected service, but in no way guarantees any result or outcome whatsoever whether successful or unsuccessful for any service selected.  Any service selected does not provide any additional service other than the service that has been selected and payment has been successfully received.  EquiResolve reserves the right to deny service to anyone for any reason.  Additionally, EquiResolve is not obligated to respond to any submitted requests.  The decision to accept or reject any submission is at the sole discretion of EquiResolve, based on any criteria EquiResolve deems appropriate.

EquiResolve’s availability of any document is limited to the databases that EquiResolve uses in its line of business. This may not be an exhaustive list of all filings related to your matter.  For an exhaustive list, research through other means must be performed.

User agrees that EquiResolve’s liability, if any, is limited to the amount of the fee charged for a particular service and paid by the user, if any.  User further agrees that should any dispute of any nature arise with EquiResolve, such dispute will be handled only through mediation and/or arbitration chosen mutually by agreement of each party .  User further agrees that such mediation or arbitration may occur via telephonically.  If any legal fees, attorney fees, court costs or other legal fees are incurred as a result of a dispute between EquiResolve and the user, the user agrees that all such fees of the user and all such fees of EquiResolve will be the financial sole responsibility of each party.  User hereby give up any and all rights to resolve any dispute with EquiResolve in a court of law.  User further agrees that the determination and/or decision or award, whatever it might be, made by the mediator and/or arbitrator will be the final decision and User hereby gives up the right to resolve this matter in any other manner, including, but not limited to an appeal and/or request for reconsideration and/or request for rehearing.  User fully understands and agree that EquiResolve does not guarantee or any other manner warrant or promise the outcome and/or result for any services offered and/or performed by EquiResolve and/or any dispute relating in any way to User’s use of this website.
